These Terms of Use (“Terms”) govern your access to and use of the Sously mobile application and any related services (collectively, “Sously” or the “Service”), provided by Sacred Spawns (“we,” “us,” or “our”).

By downloading, installing, or using Sously you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Sously.

1. The license we grant you

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Sously on devices you own or control, for non-commercial personal use, subject to these Terms and the applicable app-store rules. We retain all rights, title, and interest in Sously that are not expressly granted to you here.

You may not:

Reverse engineer, decompile, or disassemble Sously, except to the extent this restriction is prohibited by applicable law.
Resell, sublicense, or commercially exploit Sously or any part of it.
Use Sously to violate any law, infringe anyone’s rights, or harass anyone.
Probe, scan, or attempt to bypass our security, rate limits, quotas, or abuse-prevention systems.
Use automated systems (bots, scrapers) to access the Service.

2. Subscriptions, billing, and auto-renewal

Sously offers an optional paid tier called Sously Pro, with monthly, annual, and one-time lifetime purchase options. Pricing and the exact features of each tier are shown on the paywall inside the app at the time of purchase.

2.1 How billing works

On iOS, all purchases are processed by Apple through your Apple ID. Apple is the merchant of record; we receive a subscription status but never your payment details.
On Android, all purchases are processed by Google through your Google account using Google Play Billing. Google is the merchant of record; we receive a subscription status but never your payment details.

2.2 Auto-renewal

Monthly and annual subscriptions automatically renew at the price shown unless cancelled at least 24 hours before the end of the current billing period. The renewal amount will be charged to the payment method you have on file with Apple or Google within 24 hours prior to the end of the current period.

Lifetime is a one-time purchase and does not renew.

You can manage or cancel a subscription at any time:

iOS — Settings → [your name] → Subscriptions → Sously → Cancel.
Android — Play Store → profile → Payments & subscriptions → Subscriptions → Sously → Cancel.

Cancelling stops future renewals but does not refund the current period. You retain Pro access through the end of the period you’ve already paid for.

2.3 Free trials

Some subscription offerings may include a free trial. If you do not cancel before the trial ends, the subscription begins automatically at the price shown when you signed up. The trial-end date is visible in your store account at all times.

2.4 Refunds

Refunds are handled by the store where you bought the subscription — we cannot issue refunds directly because we never receive your payment.

iOS — request a refund at reportaproblem.apple.com.
Android — request a refund from the Play Store subscription detail page.

Apple and Google each have their own refund eligibility criteria; we have no control over their decisions. Where required by consumer-protection law (EU, UK, certain US states), the statutory rights granted by that law are not waived by these Terms.

2.5 Price changes

If we change the price of a subscription tier, the new price applies only to new subscriptions or to renewals that take place after the change. Apple and Google both notify existing subscribers and require explicit consent before applying a price increase to an existing subscription.

3. AI features — important disclaimers

Sously Pro includes AI-powered features (Sous Chef recipe generation, ingredient identification from photos, AI-generated recipe imagery, nutrition estimates, and AI categorization). These features are powered by third-party large language models, currently Google’s Gemini family of models. We pass your prompt and any attached photo to the model and display the result.

You must verify AI outputs before relying on them. AI models can:

Generate recipes with incorrect cooking times, temperatures, or ratios.
Misidentify ingredients in photos, including allergens.
Produce inaccurate nutrition estimates.
Suggest combinations that are unsafe for people with allergies, dietary restrictions, or specific medical conditions.

Sously is a cooking-assistance tool, not medical, nutritional, or food- safety advice. If you have a food allergy, follow a medically prescribed diet, are pregnant, or have any health condition affected by food, consult a qualified professional and verify ingredients against authoritative sources before consuming AI-generated suggestions.

We provide AI features “as is” and make no warranty about their accuracy, completeness, or fitness for any particular purpose.

4. Your content

You retain ownership of every recipe, photo, note, and other piece of content you create or upload to Sously (“Your Content”). You grant us a limited license to host, copy, transmit, display, and process Your Content solely to provide the Service to you (for example, syncing it to your devices, sharing it with members of your household if you choose to invite one, or sending it to the AI provider when you tap an AI button). We do not sell Your Content, do not use it to train AI models, and do not display it publicly.

You are responsible for ensuring you have the right to use any content you import — for example, when you import a recipe from another website, respect that site’s terms.

Sously Pro supports a 2-member household. By inviting another person to your household, you authorize them to read, edit, and delete the recipes, pantry, meal plans, shopping lists, and other content scoped to the household. Removing a member ends their further access but does not retroactively undo edits they’ve already made. If you both lose Pro access, the cloud copy stops syncing; local copies on each device remain.

6. Acceptable use

Don’t use Sously to:

Upload content you don’t have the right to upload.
Upload content that is illegal, infringing, defamatory, abusive, harassing, sexually explicit involving minors, or otherwise violates any law.
Probe or attempt to circumvent our AI rate limits, quotas, or safety filters.
Use the household feature to share an account with the public rather than a real household member.

We may suspend or terminate access to anyone who violates this section.

7. Account suspension and termination

We may suspend or terminate your account if you materially violate these Terms, abuse the Service, or if required to by law. We will use reasonable efforts to notify you in advance unless doing so would defeat the purpose (for example, ongoing fraud).

You may terminate your account at any time via Settings → Account → Delete Account, or by emailing us. See the Account Deletion page for details.

On termination, the licenses granted to you under section 1 end. Sections that by their nature should survive (intellectual-property ownership, disclaimers, limitation of liability, governing law, dispute resolution) will survive.

8. Third-party services

Sously integrates with third-party services to operate:

Firebase (Google) — authentication, database, file storage, AI inference, crash reporting, App Check attestation.
RevenueCat — subscription state aggregation.
Google Gemini API — AI text and image generation.
Apple App Store / Google Play Store — payment processing, distribution.
Sign in with Apple / Google Sign-In — authentication providers.

Each is governed by its own terms and privacy policy, which apply to your use of those services through Sously. We do not control their behavior beyond the integration scope described in our Privacy Policy.

9. Service availability; “as is”

We aim for high availability but do not guarantee that Sously will be uninterrupted, error-free, or available in every region. We may add, change, or remove features at any time, including discontinuing the Service. If we discontinue Sously Pro entirely, we will provide a reasonable notice period and prorated refunds where required by law.

EXCEPT WHERE PROHIBITED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SACRED SPAWNS, ITS OWNERS, OR ITS CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF SOUSLY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF SOUSLY WILL NOT EXCEED THE GREATER OF (A) US $50 OR (B) THE AMOUNT YOU PAID US FOR SOUSLY PRO IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those jurisdictions, the limitations above apply to the maximum extent permitted by law.

11. Apple-required terms (iOS users)

The following provisions apply only when you use Sously on an Apple device. They are required by Apple’s App Store guidelines and are in addition to the rest of these Terms:

Acknowledgement. These Terms are between you and Sacred Spawns, not Apple. Apple is not responsible for Sously or its content.
Scope of license. Your license to use Sously is limited to a non-transferable license to use Sously on any Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
Maintenance and support. Sacred Spawns, not Apple, is solely responsible for providing maintenance and support for Sously.
Warranty. In the event of any failure of Sously to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Sously to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Sously.
Product claims. Sacred Spawns, not Apple, is responsible for addressing any claims by you or any third party relating to Sously, including product liability claims, claims that Sously fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
Intellectual-property claims. In the event of any third-party claim that Sously or your use of it infringes that party’s intellectual-property rights, Sacred Spawns, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of the claim.
Legal compliance. You represent that you are not located in a country subject to a US Government embargo, or that has been designated as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

12. Changes to these Terms

If we make material changes, we’ll update the “Last updated” date at the top, post a notice inside the app on next launch, and where required by law obtain your renewed consent. Continued use after a change is acceptance of the new Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Sacred Spawns is established, without regard to its conflict-of-laws principles. Mandatory consumer-protection laws of your home jurisdiction continue to apply. Disputes will be resolved in courts located in that jurisdiction, except where a consumer-protection statute grants you the right to bring a claim locally.

14. Severability and assignment

If any provision of these Terms is held unenforceable, the rest remain in effect. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets; you may not assign them without our written consent.

Use Sously for your own cooking, not commercial resale.

You own your recipes. We don’t sell them or use them to train AI.
If we screw up, our total liability is at most what you paid us in the last year (or $50, whichever is greater).
Apple gets a few specific protections required by the App Store rules (section 11); those apply only on iOS.
